- General provisions
1.1 The rules for the purchase of goods in the online store (hereinafter referred to as the “Rules”) shall apply when placing an order with UAB “Jurgos TV idėjos”, company code 303035949, VAT payer code LT100008036411, registration address Architektų g. 56-101 , Vilnius LT-04111, address of the shop. 13, Vilnius, data collected and stored in the Register of Legal Entities of the Republic of Lithuania, (hereinafter referred to as the “Seller”) in the online store – www.jurgus.com
1.2 By placing an order in the Online Shop, the Customer confirms that he/she accepts these Terms and Conditions and, in accordance with the provisions of Section 2.1. 2.1.1., the Customer is entitled to purchase the goods in the Online Shop.
1.3 The Seller shall have the right to use third parties for the performance of the Contract.
- Ordering goods – concluding a contract
2.1 All legal entities and natural persons who have reached the age of majority, as well as minors between the ages of 14 and 18 with the consent of their parents or guardians, may make purchases in the online shop, except where they are independently disposing of their own earnings. By accepting the Terms and Conditions, the Buyer warrants that he/she meets these conditions.
2.2 The Customer shall choose the goods he likes when visiting the online shop. On the basis of his choice, a shopping basket is formed.
2.3 Before confirming the shopping cart, the Buyer must make sure that only the goods and data he wishes to purchase are correct.
2.4 The Contract between the Buyer and the Seller shall be deemed to be concluded from the moment the Seller sends the Buyer a confirmation that the order has been confirmed and the Buyer has made the payment by email or by the confirmation in the ordering account specified in the Buyer’s registration form. Payment shall be deemed to have been made from the moment the funds are actually credited to the Seller’s bank account.
2.5 Each contract concluded between the Buyer and the Seller shall be stored in the online shop.
2.6 The Seller reserves the right to consider the contract of sale as not concluded if the Buyer does not provide all the required data or parameters for the delivery or the ordered goods, makes an incomplete or partial payment, or if the contract of sale cannot be concluded due to any other objective reasons as specified in these Conditions.
2.7 The Buyer is fully responsible for the accuracy of the data provided in his registration form.
2.8 The Buyer is obliged and undertakes to protect his/her login data and not to disclose them to third parties. All actions performed using the Buyer’s login data shall be deemed to have been performed by the Buyer and the Buyer accepts full responsibility for any actions performed using his/her login data.
- Price and payment of goods
3.1 In the e-shop, payments are processed using the montonio.lt platform, which is operated by Montonio Finance, UAB (Konstitucijos pr. 7, Vilnius, company code 305205122 ), therefore, your personal information necessary for the execution and confirmation of the payment will be transmitted to Montonio Finance, UAB.
3.2 Payments can be made using Swedbank, Seb, Luminor, Citadele and Šiaulių bankas e-banking services. Payments can be made in Euro currency. Payments are processed using the Paysera.lt payment platform.
3.3 The final price of the goods in the Online Shop includes VAT. The price of the goods does not include the delivery charge payable by the Buyer. In the cases provided by the Seller, goods may be delivered free of charge.
3.4 The exact price of the Goods, the delivery price and the estimated delivery time shall be specified in the order for the Goods confirmed by the Seller.
3.5 The Buyer shall pay for the ordered goods through the Paysera system or by indicating bank card details.
3.6 The Buyer undertakes to pay for the confirmed order within 2 (two) calendar days from the date of confirmation. If the Buyer fails to pay the order in full within 2 (two) calendar days, the Buyer shall be deemed to have abandoned the order and the order shall be cancelled without any separate notification to the Buyer.
- Delivery of goods
4.1 The Goods shall be dispatched to the Buyer’s address within 2-3 (two-three) working days after receipt of full payment for the Goods and shipping costs to the Seller’s account.
4.2 Normally, the shipment shall reach the Buyer within 1-2 (one – two) working days in Lithuania, within 2-7 (two – seven) working days abroad from the date of shipment. The Seller shall not be responsible or liable for the delivery time of third parties.
4.3 The Seller shall in all cases be exempt from liability for late delivery of the Goods if the failure to deliver the Goods to the Buyer on time is due to the fault of the Buyer or due to circumstances beyond the Seller’s control, including, but not limited to, the acts or omissions of any third party delivering the shipment.
4.4 Upon delivery of the Goods to the address specified by the Buyer, the Goods shall be deemed to have been handed over to the Buyer irrespective of whether the Goods are actually received by the Buyer or by any other person who has received the Goods at the specified address. The Seller shall not be liable for, and shall not verify, whether the goods are collected by the person specified in the order.
4.5 If the Buyer provides an incorrect or incomplete delivery address or fails to collect the goods from the delivery service provider within the maximum retention period, the Buyer shall be liable to pay the Seller’s additional costs of returning the parcel and resending the goods to the Buyer’s corrected address.
4.6 Upon delivery, the Buyer (Buyer’s representative) undertakes and is obliged to inspect the condition of the packaging of the consignment of goods, the quantity, the quality of the goods (obvious defects) and the assortment. In the event of any damage to the packaging of the consignment, the Buyer (Buyer’s representative) shall notify the person delivering the consignment in writing on the consignment acceptance document or refuse to accept the consignment. The Buyer must immediately inform the Seller and provide photographs of the damaged consignment and/or goods. In the event of any discrepancy(s) in the quantity and/or quality and/or range of the goods, the Buyer (Buyer’s representative) must not accept the consignment. Once the Buyer (Buyer’s representative) has accepted the consignment of goods and signed the relevant delivery document without comment, it shall be presumed that the goods have been delivered in an undamaged consignment package, the quantity and assortment of the goods are in accordance with the terms and conditions of the order, and the goods are free from any obvious defects.
4.7 If for important reasons or technical problems the Seller is unable to deliver the goods ordered by the Buyer, the Seller undertakes to offer the Buyer an analogue product and, if the Buyer refuses to accept the analogue product, to refund the Buyer’s payment within 14 days from the moment of refusal. In this case, the Seller shall be released from liability for non-delivery of the goods.
- Product warranty
5.1 The details of the goods sold in the Online Shop shall be set out in the description of each product.
5.2 The colour, shape or other parameters of the goods presented in the Online Shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the display used by the Customer. This shall not be deemed to be a defect in the quality of the goods or a discrepancy with the description of the goods.
5.3 The quantities of goods shown in the pictures on the online shop do not always relate to the price of the goods – there may be more than one unit price shown. The units of measurement are indicated in the product description.
5.4 The Seller guarantees the quality of the Goods (statutory quality guarantee). The Seller may grant a quality guarantee for different Goods for a certain period of time, the specific term and other conditions of which are specified in the description of such Goods.
5.5 The Buyer is advised that jewellery may scratch on contact with each other or with other surfaces and is advised to keep the jewellery separate from each other, to avoid contact with sharp surfaces and to protect it from impact and other possible mechanical damage. Jewellery should also be protected from contact with chemicals, sudden changes in temperature, heat, salt-laden or chlorinated water. Jewellery may discolour and oxidise, especially if it is not worn or if it is stored in a humid room. These changes do not constitute a failure of the product to meet the quality requirements. Jewellery must be cleaned with special materials and means to avoid damaging the surface.
- Right of withdrawal (for consumers only)
6.1 In accordance with Clause 17.12 of the Rules of Retail Trade approved by the Government of the Republic of Lithuania by Resolution No.697 of 11 June 2011 (2014-07-29), quality pearls, precious stones, precious metals and their articles, except for artificial jewellery (codes according to the Combined Nomenclature – 7101-7116, 7118), purchased in local outlets, are not exchangeable and are not returnable.
6.2 The Buyer-Consumer shall have the right to withdraw from the contract of sale concluded with the Seller in the online shop without giving any reason, by notifying the Seller in writing within 14 calendar days of receipt of the goods. The Buyer must give notice to the Seller by e-mail info@jurgagusaroviene.com or by post to Didžioji g. 13, Vilnius. The notification must clearly state that the Buyer cancels the contract of sale, returns the goods and requests a refund, the Buyer’s account to which the Buyer wishes to receive the refund, and a document confirming the purchase of the goods from the Seller.
6.3 The Buyer-Consumer may only exercise the right to return the Goods if the aforementioned 14-day return period has not been missed. The Buyer must deliver the Goods to the Seller’s point of sale at Didžioji str. 13, Vilnius, or send it by registered mail / courier service to the Seller’s address Didžioji g. 13, Vilnius, with delivery to the recipient. The risk of loss or damage to the goods shall be borne by the Buyer until the goods are handed over to the Seller.
6.4 In accordance with Regulation 6.2. 6.6.2, the returned product must be in good condition, without mechanical damage, without loss of merchantable appearance, with all former labels, quality certificates, in the original packaging and unused. In the event of defects in the goods or their packaging or signs of wear and tear, the cancellation of the contract of sale shall not be enforceable and the Seller shall have the right not to accept the returned goods and not to refund the money to the Buyer. In this case, the Buyer shall be entitled to collect the goods from the Seller.
6.5 The Consumer Buyer shall, in accordance with 6.2. 6.2. of the Rules, the Consumer who has withdrawn from the contract of sale shall be refunded all money paid for the goods, excluding the cost of delivery of the goods to the Buyer, provided that the goods have been returned within the time limit and comply with the requirements of 6.3. of the Rules. In the case of a purchase made in accordance with clause 6.6. The Buyer shall bear the direct costs of returning the goods. Upon receipt of the returned goods, the Seller shall refund the money to the Buyer-Consumer to the bank account specified by the Buyer-Consumer only after checking the returned goods at the Lithuanian Assay Office to ensure that the returned goods are returned in the same condition as they were sent to the Seller.The checking of the returned goods at the Lithuanian Assay Office is the Seller’s right, but not the obligation.
6.6 In accordance with Regulation 6.2. 6.6.2 of the Sale and Purchase Agreement shall not apply to, and the Buyer shall not be entitled to exercise the right of withdrawal in respect of, goods made to the Buyer’s special order, which have not been pre-manufactured, which have been manufactured in accordance with the Buyer’s personal choice or instruction, or goods which have been expressly tailored to the Buyer’s personal needs (for example, a change in the size of a jewellery item, etc.).
- Product disadvantages
7.1 Upon receipt of the Goods, the Buyer shall be obliged to inspect the Goods immediately, to check their quality and to ensure that they are free from defects. If the delivered goods do not meet the quality requirements, the Buyer must immediately contact the general contacts of the online store in the “Contacts” section of the online store, indicate the defect of the goods, and provide photographs.
7.2 Defects in the Goods shall be rectified and faulty Goods shall be replaced or returned in accordance with the requirements of the legislation of the Republic of Lithuania. In all cases, the Buyer shall be obliged to provide a document confirming the purchase of the goods from the Seller.
7.3 The Goods may not be accepted or exchanged if the Buyer fails to notify the Seller within a reasonable time after the Buyer has noticed or ought to have noticed the defect in the Goods and to specify the non-conformity of the Goods.
7.4 The Buyer shall deliver the goods to the Seller’s sales outlet at Didžioji g. 13, Vilnius, or send it by registered mail/courier service to Didžioji g. 13, Vilnius, with delivery to the recipient. The risk of loss or damage to the goods shall be borne by the Buyer until the goods are returned to the Seller. If the goods are found to be faulty, the Seller shall bear the cost of returning them.
7.5 The Seller shall have the right not to accept the Buyer’s return and not to comply with the Buyer’s request if the defects in the Goods are due to misuse, mechanical damage or other acts beyond the Buyer’s control, or to natural wear and tear.
7.6 In the event of a return of the wrong Goods and/or a faulty Goods, the Seller undertakes to accept and remedy the faults or to replace the faulty Goods with similar Goods of the same quality. In the event that the Seller does not have suitable goods available for replacement, the Buyer shall be refunded the amount paid, including the price for delivery.
